Prostate Commander Prostate CommanderThe full edition of Prostate Commander is provided under the following licence agreement – for partners in further development and new projects. The OPEN test edition is subject to the terms of use below. The installer shows both texts, they must be accepted before installation and accompany every installation. The spelling matches the text files of the installation; in case of discrepancies the German version prevails.

Licensor: Dr. Herbert Schuster, deepnet.at (the "Licensor"). Licensee: the natural or legal person installing or using the software (the "Licensee"). The software "Prostate Commander" including program, help, report templates and documentation (the "Software") is provided exclusively under the following terms. By installing, copying or using the Software the Licensee declares unreserved acceptance. Anyone who does not agree must neither install nor use the Software.
1.1 The Software is a research and development tool for the evaluation of prostate MRI data. It is not a medical device within the meaning of Regulation (EU) 2017/745, is not CE-certified and is not intended for clinical diagnosis, treatment decisions or patient care.
1.2 Every segmentation, lesion marking, score, report and simulation is a technical suggestion without medical validity. The medical assessment rests solely with the Licensee, who verifies every result on their own responsibility before using it in any way.
1.3 The Licensee ensures that the use is permissible in their environment, in particular under medical device, professional and data protection law. Any use for which an approval, certification or conformity assessment is required is prohibited.
2.1 The Licensor grants the Licensee a simple, non-exclusive, non-transferable, non-sublicensable right, limited to the version series 1.x, to use the Software on ONE workstation (one installation) for the Licensee's own purposes. Every additional workstation requires an additional licence.
2.2 One backup copy is permitted. The following in particular are prohibited: passing on, renting, lending, selling, making publicly available, use for third parties as a service, decompiling, disassembling and reverse engineering beyond what is mandatorily permitted by law, circumventing or altering technical protection measures (for example computation counters, licence files), removing or altering copyright, licence and warning notices, and using the Software or its output to train or develop competing products.
2.3 The Software is protected by copyright. All rights not expressly granted remain with the Licensor. The source code is not part of the licence. The designation "OPEN" of the test edition denotes the trial function and does not constitute an open-source licence.
2.4 Models created with the Software (MyTrain) belong to the Licensee, who alone is responsible for the data used and for compliance with the terms of the underlying third-party models (clause 4.2).
3.1 The conditions of provision, in particular consideration and scope, are agreed separately. The Licensor's aim is cooperation with partners for the further development of the Software and for new projects.
3.2 Updates of the version series 1.x are provided at the Licensor's sole discretion. There is no entitlement to updates, bug fixes, further development, support or compatibility with future operating systems, devices or data formats. New version series may require a new agreement.
4.1 The Software contains third-party components under their own licences (Python, OpenCV, NumPy, SciPy, pydicom, Pillow, lxml and others; complete list and licence texts in the file "Drittanbieter-Lizenzen.txt" in the program folder). For the respective component these licences take precedence over this agreement.
4.2 The AI segmentation uses the model weights "Models for Prostate158" (Keno Bressem, Charite - Universitaetsmedizin Berlin; doi:10.5281/zenodo.6397057) under the licence Creative Commons Attribution 4.0 International (CC BY 4.0). These weights are not part of this agreement; they are downloaded at the first AI call and are available to the Licensee under CC BY 4.0. The Licensee complies with its terms, in particular attribution whenever the weights are passed on.
4.3 The optional AI environment (PyTorch, MONAI and further libraries) is downloaded from the internet by the installer at the Licensee's request. It is not part of the delivery, is subject to the licences of its providers, and its availability is not owed.
5.1 The Software is provided "as is". The Licensor gives no warranty for correctness, completeness, availability, fitness for a particular purpose, freedom from defects, compatibility or for the results of segmentation, lesion scoring, ADC computation, reports and simulation.
5.2 The Licensee has tested the Software for suitability with the free OPEN test edition before use; the properties of the test edition are the agreed quality. Samples, descriptions and statements on the website are not warranties.
5.3 Where a warranty cannot be excluded by law, it is limited, at the Licensor's option, to repair or replacement. Defects must be notified in writing and comprehensibly within 14 days of becoming recognisable, otherwise claims are excluded. The burden of proof that a defect existed at delivery lies with the Licensee; the presumption of section 924 of the Austrian Civil Code (ABGB) is excluded.
6.1 The Licensor's liability for slight negligence is excluded. This does not apply to personal injury.
6.2 To the extent permitted by law there is no liability for consequential damage, indirect damage, lost profit, loss of data, business interruption, third-party claims, or damage resulting from incorrect or omitted medical decisions based on output of the Software.
6.3 To the extent permitted by law, liability is in any case limited in amount to the typical, foreseeable damage and at most to what the Licensee has provided for the provision of the Software; where the Software is provided free of charge, liability is excluded.
6.4 The Licensee indemnifies the Licensor against all claims of third parties, including patients, authorities and payers, arising from the use of the Software or its output by the Licensee or by persons to whom the Licensee has granted access, including reasonable costs of legal defence.
6.5 Claims for damages against the Licensor become time-barred six months after knowledge of the damage and the liable party, and at the latest two years after the damaging event.
7.1 The Software works locally and transmits no data to the Licensor. The Licensee is the sole controller within the meaning of the GDPR for all patient data processed, for reports, exports, backups, access protection and deletion.
7.2 The Licensee is responsible for backing up their data. The Licensor is not liable for loss of data.
7.3 For enquiries and support the Licensee transmits no personal patient data; log files and screenshots must be checked and cleaned beforehand.
8.1 The licence is valid indefinitely for the version series 1.x, subject to clause 8.2.
8.2 On any breach of this agreement the licence terminates immediately and without further notice. The Licensee must then uninstall the Software without delay and delete all copies. Further claims of the Licensor remain reserved.
8.3 The Licensor may at any time request proof of the licensed workstations; the Licensee provides written information within 14 days.
9.1 The Software is licensed exclusively to entrepreneurs, self-employed professionals, practices, hospitals, research and educational institutions, not to consumers.
9.2 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. Place of jurisdiction is the competent court at the Licensor's seat; the Licensor may also sue the Licensee at the Licensee's general place of jurisdiction.
9.3 Amendments and side agreements require written form; this also applies to any waiver of this written-form requirement. General terms and conditions of the Licensee do not apply, even if they are not expressly objected to.
9.4 Should a provision be or become invalid, the remainder of the agreement remains valid; the invalid provision is replaced by the valid provision that comes closest to its economic purpose.
9.5 This agreement exists in a German and an English version; in case of discrepancies the German version prevails.

It is limited to 30 PIRADS computations, stores nothing beyond the session and deletes its working folders at program end. There is no entitlement to provision, updates, support or continuation; the Provider may discontinue or change the test edition at any time. By installing or using the software the user declares unreserved acceptance of these terms.
